SUBJECT: Alleged Zoning Violation (ZV508-01): Parking Lot Construction

Assessor's Parcel: 002320220070A (Lots 7 and 8, Block 22, Lake San Souci, Unit 2) Zoning District: Suburban-1/4

Dear CDS Association and Ms. Kent:

It has been brought to staff's attention that a use occurring on your property, described above, may be in violation of Bonner County Revised Code. Commercial uses are prohibited in the Suburban District, unless otherwise specified. (Section 12-970[a], BCRC) Further, once a conditional use permit is approved, the terms and conditions of the conditional use permit shall become the controlling plan for the property. (Section 12-2101[b], BCRC)

Conditional Use Permit 609-96 was issued February 11, 1997. (Copy attached.) Condition 1 specifies that "the use shall be in accordance with the approved site plan." Note that the site plan does not include the conversion of residential Lots 7 and 8 into a parking lot. Rather, pursuant to Condition 7, "the applicant shall provide 35 parking spaces adjacent to the sales office as per the approved site plan and shall maintain a minimum of 98 parking spaces for the athletic complex facility." (Partial site plan enclosed.) If necessary, however, the terms and conditions of the approved permit can be modified should CDS need to relocate the approved "proposed parking." (BCRC, Section 12-460)

Lastly, an approved storm water management plan is necessary prior to any land disturbing activities, such as site grading, that is preparatory to the expansion or alteration of the Stoneridge resort. (BCRC, Section 12403 [f]

Please contact this department in writing at your earliest opportunity regarding the purported conversion of Lots 7 and 8 into a parking lot, but no later than Wednesday, October 3, 2001. Thank you for your anticipated cooperation.

CONDITIONAL USE PERMIT C609-96

TO: KEITH GARNER, P.O. BOX 277, BLANCHARD, ID 83804

PURPOSE: To bring into conformance an existing golf course/recreation complex and to construct an addition to the pro shop, restrooms on the golf course, a golf cart storage building, indoor recreation facility and multi-purpose building.

LOCATION: Generally described as portions of the W 1/2 of Section 20 and the E 1/2 of Section 19, south of Blanchard Road, all in Township 54 North, Range 5 West, B.M.

CONDITIONS OF APPROVAL:

  1. The use shall be in accordance with the approved site plan.
  2. The Conditional Use Permit shall not supersede deed restrictions.
  3. All county setbacks shall be met.
  4. The Conditional Use Permit shall expire if not issued within two (2) calendar years from the date of approval, or once issued, if the use has not commenced within two (2) calendar years from the date of issuance. At any time prior to the expiration date of the Conditional Use Permit, the applicant may make a written request to the Planning Director for a single extension of the Conditional Use Permit for a period up to two (2) years. The Planning and Zoning Commission may consider such request for extension at any public hearing. The extension request must be approved or denied prior to the expiration date of the Conditional Use Permit.
  5. The applicant shall install prior to ground disturbing activities all temporary erosion control measures as designed and approved. The applicant shall provide to the Planning Department prior to ground disturbing activities a signed statement from the project engineer or design professional slating that these measures have been installed as per the design specifications as approved. The applicant shall install upon completing ground disturbing activities and shall maintain thereafter all permanent erosion control and stormwater management measures as designed and approved.   6. The applicant shall obtain written approval from the Idaho Division of Environmental Quality for the golf course restrooms and all facilities requiring sewer and water service prior to issuance of building permits or construction. A copy of the approval shall be submitted by the applicant to the Bonner County Planning Department.
  7. The applicant shall provide 35 parking spaces adjacent to the sales office as per the approved site plan and shall maintain a minimum of 98 parking spaces for the athletic complex facility.

 

This Conditional Use Permit is issued pursuant to the January 9, 1997 decision of the Bonner County Planning and Zoning Commission.

The use of the SFD on Lot 10, Block 21, as a "temporary office structure" is permitted for up to two years. (BCRC, Section 12-930[b])

Lots 7 and 8, Block 22, to be turned into a parking lot are zoned for SFDs, not for parking for a clubhouse. The applicant will need to include that proposal in their commercial resort CUP that you are working on. In addition to the CUP, a stormwater plan is needed. (BCRC, Section 12-2403[f]) C609-96 was not approved providing for parking on Lots 7 and 8 for the clubhouse. (See Sewell file "STONEUSE," dated 1-8-97)

Marty, I told Kevin that I need 6 copies of the site plans for Randy, I guess that is "some" and will get those to you next week.

Rob had said something to me regarding these inquiries about a month ago and Clair asked as well and I told them both on separate occasions what was happening. I told them that the house is being used as an office space for a time. The house does not have a liquor license and they are not serving beverages.

Yes two lots will be turned into a parking lot for the club house. We will be removing trees and moving dirt in the near future. There is nothing that prohibits us from moving dirt.

I sorry that people are upset that they are unable to play golf this year but it will get better next spring and they can play again. There has been substantial work on all the fairways, tees and green but again we are moving dirt and growing grass.

I have spoken with Clair regarding a site visit for the Dept. a couple of weeks ago and have not heard back. A Friday is fine with Roger and I. Contact use with a date and time you should figure and 1/2 a day to see the whole project.

If you want, you could throw some 11" x 17" site plans my way. Because of the limited nature of the modification, I'm not sweating site plans. It might be handy, I suppose, to have a map for the Planning Commissions to look at showing the locale of the First and Second Additions relative to Double D Thanks.

As a side note, got the legal description for Priest Lake Golf vacation. This'll work. See you Oct. 18 for a 10 minute hearing.

On another note, staff is receiving inquiries (read "complaints") regarding realigning the 18th fairway and golf cart paths, turning a house into some kind of a sales office and "beer tasting" facility, not providing parking as required by C609-96, turning two residential lots into a parking lot, all out at Stoneridge. Staff will be writing CDS regarding all of this stuff. They may want to check with the zoning codes and the issued CUP before they get too ambitious out there. Thought you might be able to help us as their "representative."

I did not see anything regarding the number of sets of plans you need. I think last time Rob and I went with 11"X17".
